Probate Case Management Conference Calendar

If the tentative ruling is accepted, no appearance is necessary unless otherwise indicated. You must notify the probate clerk at (707) 521-6893 if you wish to be heard in response to the tentative ruling. You must inform the clerk concerning your appearance choice: Zoom or in person. Any interested party who wishes to be heard in opposition to a petition must notify all other parties of the intent to appear. Both notifications must be completed no later than 4:00 p.m. on the court day immediately preceding the day of the hearing.

Unless notification to the probate clerk has been given as provided above, the tentative rulings shall become the rulings of the court at 3:15 p.m. on the day of the hearing.

  • After joining the meeting and checking in with the clerk, please mute your audio when not speaking. This helps keep background noise to a minimum.
  • Be mindful of background noise when your microphone is not muted. Avoid activities that could create additional noise, such as shuffling papers.
  • Position your camera properly if you choose to use a web camera. Be sure it is in a stable position and focused at eye level, if possible. Make sure everything visible in the frame is appropriate for an appearance in court.
  • If a confidential session becomes necessary, it is incumbent on you to ensure you are able to participate from a private location so that unauthorized people cannot overhear or see the proceedings.
  • Chat is enabled for the sharing of documents among participants and the court and to allow attorneys to communicate individually with each other or their clients only. No chat messages should be sent privately to the court as it would amount to an unauthorized ex parte communication. Neither should chat messages be sent to all participants unless directed by the court.
  • The recording function has been disabled. Remember, the prohibition against recording court proceedings, even remote ones, remains.
  • Be patient. Check in will take more time and the experience from those who have tried this before is that proceedings are a little slower generally.

  1. Estate of Sherman Blackwell

Tentative Ruling: NO APPEARANCES REQUIRED.  In light of the information provided in the status update filed June 22, 2026, this matter is CONTINUED to November 5, 2026, at 3:00 p.m. in Dept. 12 for status of Inventory and Appraisal as well as Final Account and Distribution.  The stay on sanctions and other terms ordered at the January 29, 2026 hearing shall continue in effect for consideration at the next hearing.  As to the license status of counsel, the Court is satisfied its order to relay the circumstances to the State Bar has been complied with and leaves further action, if any is necessary or appropriate, to the State Bar.

Tentative Ruling: NO APPEARANCES REQUIRED.  Matter is CONTINUED to January 28, 2027 at 3:00 p.m. in Dept. 63.  If a petition for approval of final distribution and account, or on waiver of account, has not been filed at least 10 days prior to the hearing, the executor will be removed at that time, and the case dismissed without prejudice.  The executor will not be discharged and will remain personally liable for any breaches of fiduciary duty to the extent allowed by law and supported by the facts.

Tentative Ruling: NO APPEARANCES REQUIRED.  The Court has received and reviewed the response to the Order to Show Cause (OSC) and is satisfied with the explanation provided.  The OSC is dismissed.   The response attaches a First Account and Report of the Conservator, however this is a document that must be filed as a petition with a notice of hearing and served on all parties.  It appears conservator may have attempted to do just that but the filing was rejected.  This matter is therefore CONTINUED to October 1, 2026 at 3:00 p.m. in Dept. 12 to allow conservator another opportunity to file a petition for approval of the first account and report.  However, based on the information provided in the attachment to the response to the OSC, it appears the conservatee may qualify for a waiver of account (Request and Order for Waiver of Accounting, Judicial Council Form GC-410).  If appropriate, conservator may instead file for a waiver of account.

On November 14, 2024, this Court issued an OSC re: Dismissal.  The matter has been continued since that time.  At the last hearing, the administrator represented that the proper forum for the estate was in fact New York State.  There has been no change in the status of the case since that hearing and no update filed.  The matter is DISMISSED without prejudice and on the terms stated in the 2024 OSC.

Tentative Ruling: NO APPEARANCES REQUIRED. The Court has been informed that the bankruptcy proceedings have concluded, but the bankruptcy court has not yet issued a final order. In light of the fact the bankruptcy court granted petitioner a judgment in her favor in the bankruptcy Adversary Proceeding, any debt not satisfied through distribution from the bankruptcy estate will remain subject to collection.  Counsel for petitioner represents the following agreement has been reached in light of this: Debtor respondent will appear at petitioner’s counsel’s office before a Certified Court Reporter authorized to administer oaths at a mutually agreed upon date within sixty days of the bankruptcy court’s issuance of the final order to give testimony and provide documents that will assist petitioner in the collection of any unsatisfied judgment. Counsel will meet and confer concerning the documents debtor respondent will produce at the examination, and if they are unable to agree petitioner will request an order requiring the production of particular documents at the examination.  The Court approves the agreement and in light of it, CONTINUES this matter to October 8, 2026 at 3:00 p.m. in Department 12, for confirmation that the examination has occurred.

Tentative Ruling: NO APPEARANCES REQUIRED.  Per the case management statement filed June 17, 2026, a petition for approval of settlement agreement will be filed.  While none has yet been filed, the Court notes on June 18, 2026, a petition was rejected for filing.  This matter is therefore CONTINUED to October 8, 2026 at 3:00 p.m. in Dept. 12 to allow another opportunity to file a petition for approval of settlement agreement.

Tentative Ruling: NO APPEARANCES REQUIRED.  This matter is on for the tenth hearing since the petition for probate was heard in 2021.  In light of the information contained in the case management statement filed June 11, 2026, the matter is CONTINUED to October 15, 2026, at 3:00 p.m. in Department 12 for status of final distribution and account.  If a petition for approval of a final distribution and account, or on waiver of account, has not been filed at least seven days prior to the next hearing, the Court will issue an Order to Show Cause why the administrator should not be removed and/or sanctioned and the case dismissed without an order of discharge.  The Court directs that a copy of these minutes be mailed to the bond company.
